TERMS OF USE

1. DEFINITION OF TERMS

The following definitions apply in the context of these Terms of Use:

1. The Platform terappio.com is an online platform that hosts information on psychology and related fields. The platform also provides an opportunity for Psychologists to post information about themselves (their experience, specialization, work format) and provide individual consultations based on the results of which the user of the website (Client) can obtain the necessary knowledge and information. The Platform operates through the domain www.terappio.com and offers its services through this Website and related services.

2. The Website (or Internet site) is a comprehensive resource containing software and various content available via the Internet at certain domain names or network addresses that identify the site on the network. For the purposes of this Agreement, the term "Website" means www.terappio.com.

3. The Contractor/Company is Terappio OÜ (16586404) at Harju maakond, Tallinn, Kesklinna linnaosa, Tornimäe tn 3 // 5 // 7, 10145, Estonia.

4. Website Administration - the Contractor/Company and its authorized persons representing the interests of the Website.

5. The User of the Website (hereinafter referred to as the User) is any individual who uses or intends to use the resources of the website www.terappio.com, including both clients and psychologists.

6. The Website Content (hereinafter referred to as the Content) shall mean intellectual property objects, including texts, annotations, articles, illustrations, photographs, music, graphic and text elements, trademarks, logos, as well as software, databases, design, structure and other components that form the content and visual interface of the Website.

7. Application is a Client's request to the Psychologist for psychological services.

8. Client - a person seeking psychological help or support and using the Website to obtain information about Psychologists and/or directly to receive their services.

9. Psychologist - a practical psychologist, a specialist in the relevant field, who has duly executed documents confirming his/her education (psychological, pedagogical, social work or medical), work experience and qualifications, who provides information and data in the field of practical psychology to an unlimited number of persons, exchanges experience, knowledge, opinions with other consultants, and provides his/her services on the Platform in the manner prescribed by the Terms. In order to publish a Psychologist's profile on the Website, such a Psychologist must be verified by the Website Administration.

10. The Personal Account is a personal section on the Website, access to which is granted to the Psychologist after authentication.

11. Session - a meeting or consultation between the Client and the Psychologist for the purpose of providing psychological services.

12. Services - activities of the Website aimed at choosing a Psychologist for the Client and vice versa, as well as other services offered on the Website.

13. Public offer - this agreement on the Terms of Use is a public Agreement, which is considered to be concluded between the Company on the one hand and the User (Psychologist) on the other hand from the moment the latter accepts all the terms and conditions of the rules for the provision of services of this Agreement without exception and which is the only source of regulation of all terms of service, privileges, relations between the User and the Contractor/Company arising in the process of their implementation and compliance in the relevant field of knowledge. Acceptance of these Terms and Conditions (Acceptance) is mandatory for persons (after authorization - Psychologists) interested in obtaining the opportunity to publish their profile through the Platform in order to attract clients.

14. Acceptance means full, unconditional and unconditional acceptance by the User (Psychologist) of the terms of the public offer, Terms of Use offered on the website/platform. Acceptance is carried out by filling in the registration form and sending it as a sign of acceptance of this Agreement (Terms) in a special field in the modal window of registration/authorization of the site during profile registration.

2. GENERAL PRINCIPLES

2.1 This document on the Terms of Use (hereinafter referred to as the Agreement/Terms) applies to the website www.terappio.com.

2.2 The website www.terappio.com (hereinafter referred to as the Website) is the property of Terappio OÜ (16586404), Harju maakond, Tallinn, Kesklinna linnaosa, Tornimäe tn 3 // 5 // 7, 10145, Estonia.

2.3 The Agreement regulates the procedure for interaction between Terappio OÜ (16586404) (hereinafter referred to as the Company) and users of the Website - both Psychologists and Clients.

2.4 The Website Administration reserves the right to make changes to the Agreement at any time without prior notice. The latest version of the Agreement is always available at: www.terappio.com/terms-and-conditions.

2.5 Acceptance of these Terms is mandatory for Users: - Clients interested in obtaining information in the field of practical psychology and/or individual consultations of specialists/practical psychologists through the Platform; - Psychologists interested in posting their profile on the Website in order to attract clients. These Terms are an agreement on access to the Website/Platform, which, among other things, obliges the User to comply with them.

By using the Site, including browsing, searching for information, accessing services (hereinafter referred to as the use of the Site), the User confirms his/her agreement with the Agreement and all amendments thereto. In case of non-acceptance of the terms of the Agreement, the User shall immediately stop using the Website.

2.6 The User is obliged to familiarize himself with the current version of the Agreement. Continued use of the Website after changes to the Agreement are made means acceptance of these changes.

2.7 The User declares that he/she is at least 18 years old or has reached the age of majority in his/her place of residence, if the age of majority in this jurisdiction is over 18 years, or if the User is considered a minor in his/her country, he/she has the permission of his/her parents or legal guardian.

2.8 The User is aware and agrees that his/her personal data will be processed in accordance with the Privacy Policy, which is available here: https://www.terappio.com/notice-of-privacy. The Company may unilaterally change the Privacy Policy.

By agreeing to these Terms, the User also agrees to the provisions and rules of the Law of Ukraine "On Personal Data Protection" and expresses his/her consent to their processing and storage.

2.9. MEDICAL WARNING

2.9.1. The services provided are not intended for use in emergency situations. If the Client has thoughts of self-harm or harming others, or any other physical or mental symptoms that indicate a serious emergency or life-threatening condition, it is recommended to immediately visit the nearest hospital emergency room or call the appropriate emergency number without delay.

2.9.2. The Platform is not intended to provide clinical diagnosis requiring a face-to-face examination or to address acute mental health crises requiring face-to-face treatment, and the Client should not use it if he/she requires any official documentation or authorizations for purposes such as, but not limited to, court-ordered therapy.

2.9.3. The Platform is also not intended to provide any information about which prescription drugs or medicines may be suitable for the User, nor to provide them.

2.9.4. For the avoidance of doubt, the Company is not a medical service provider.

2.9.5. Do not use the Website/Platform to receive medical care (including emergency care).

2.9.6. The Platform does not recommend, refer to, support, evaluate, or guarantee any advice, treatment information, links to medical facilities, products, procedures, doctors, consultants, coaches (trainers), psychotherapists, tests, any other opinions, or any other information provided by any Psychologist through the Website and/or the Platform.

3. BASIS OF THE AGREEMENT

3.1 The basis of this Agreement is to provide Users with access to the capabilities of the Site for organizing interaction between the Psychologist and the Client.

3.1.1. The Website is provided to the User for the following purposes: - use of search and navigation tools on the Site; - obtaining information about psychologists and the services they provide; - obtaining journalistic materials in the "Blog" tab; - using other services available on the Site.

The Platform does not make any guarantees regarding the content of any response and/or message and/or consultation of the Psychologist and/or the information contained therein.

3.1.2 The Agreement covers all services of the Website existing at the time of its conclusion, as well as any future modifications and addition of new services.

3.2 Access to the Website and its functions is provided to Clients free of charge.

3.3 Registration of Psychologists on the Website is free of charge.

3.4 Psychologists pay a commission fee of 50% of the sum of the first five sessions with each client attracted through the Website, provided that they are held. The commission is calculated according to the price of the Session specified by the Psychologist in the Personal Account.

3.5 Payment of the commission is made through the Stripe acquiring system and Monobank (Universal Bank), with the possibility of using Apple Pay, Google Pay, bank card or MonoPay.

3.6 In case of using promotional codes to receive discounts or bonuses, the terms of access to the Website and its services for Psychologists and Clients are regulated in accordance with these promotional codes.

3.7. This Document is considered a public offer. Joining the Agreement by the User is carried out by any actions using the Website, including the initial opening of any of its pages in an Internet browser on the User's device.

3.8 The use of resources and services of the Website is subject to the laws of the Republic of Estonia.

4. RIGHTS AND OBLIGATIONS OF PARTICIPANTS

4.1 Rights of the Site Administration:

4.1.1 To make changes to the rules of use of the Website and the content of the Website. The changes shall come into force from the moment they are published on the Website.

4.1.2 Restrict the User's access to the Website in case of violation of the terms of this Agreement.

The Website Administration shall have the right to immediately block access to the Psychologist's Personal Account or restrict the use of the Services at its sole discretion if:

4.2 User's rights:

4.2.1 Use the Website in accordance with its purpose.

4.2.2 Contact the Website Administration with questions regarding the operation of the Website using the contact information posted in the relevant section on the Website.

4.2.3 Use the Website within the limits set forth in this Agreement without violating applicable law.

4.3 Obligations of the User:

4.3.1 At the request of the Website Administration, provide information related to the use of the Website.

4.3.2 Respect the rights and legitimate interests of authors and copyright holders when using the Website.

4.3.3 Refrain from actions that may disrupt the normal operation of the Website.

4.3.4 Not to distribute through the Website information of a confidential nature or protected by law.

4.3.5 Prevent any attempts to illegally access protected information.

4.3.6 Avoid placing advertisements on the Website without the permission of the Website Administration.

4.3.7 Refuse to:

4.3.7.1. Dissemination of materials that call for illegal actions or violate applicable law.

4.3.7.2. Actions that may cause harm to minors.

4.3.7.3. Impersonating another person or representative of an organization without proper authority.

4.3.7.4. Discrediting other Users or creating a negative opinion about persons associated with the Website.

4.4 Prohibitions for the User:

4.4.1 Use automatic systems to collect information from the Website without the permission of the Website Administration.

4.4.2 Interfere with the operation of the Website, in particular through mass requests that may interfere with its stability.

4.4.3 Bypass the navigation structure of the Website to access non-public information.

4.4.4 Provide unauthorized access to the functions of the Website or other networks.

4.4.5 Violate the security measures of the Website or networks connected to the Website.

4.4.6 Use the Website for activities prohibited by law.

4.5 Duties of the Psychologist and rights of the Client.

When working with a Client, a psychologist must comply with the laws of the state where consultations are conducted and the code of ethics of the International Federation of Psychotherapy (IFP). Here are the basic principles:

4.5.1 Confidentiality and protection of personal information. Psychologists are obliged to protect the privacy of Clients. Ensure that all information provided during therapy is kept confidential, except when the law or ethical standards require disclosure (e.g., threat to the life of the Client or other persons).

4.5.2 Respect for the rights and dignity of Clients. Psychologists shall respect the rights, dignity and autonomy of their Clients, including their right to make decisions about their therapy. They should show sensitivity and tolerance to the cultural, religious, gender, racial, and social differences of Clients.

4.5.3 Competence and professional responsibility. Psychologists should work only within their professional competence, which is based on appropriate education, experience, and training. They are obliged to maintain and improve their knowledge and skills through continuous learning and professional development.

4.5.4 Protection from exploitation and harmful influences. Psychologists have no right to use their professional relationships with Clients to obtain any personal, social, or financial benefits. Any form of exploitation of Clients, including sexual or emotional relationships, is prohibited.

4.5.5 Honesty and transparency. Psychologists should be honest with their clients about the nature of therapy, expected outcomes, risks, and costs of services. They should ensure transparency in their professional relationships and avoid any form of fraud or deception.

4.5.6 Safety and well-being of the Client. The main goal of the Psychologist is to ensure the well-being of the Client. The Psychologist is obliged to act in the interests of the Client and provide support aimed at strengthening their mental health. The Psychologist shall not provide services that may harm the Client.

4.5.7 Respect for the boundaries of professional relationships. Psychologists shall respect professional boundaries and avoid conflicts of interest. Any relationship outside of the therapeutic relationship that may affect the quality of therapy or the ethics of the Psychologist's actions should be avoided.

4.5.8 Professional responsibility to colleagues and society. Psychologists should act in accordance with ethical standards not only in their work with clients, but also in their interaction with colleagues, supporting the professional community, sharing knowledge and experience. They are also obliged to maintain a positive image of the psychology profession in society.

4.5.9 Providing assistance in emergency cases. If the Client is in a crisis or life-threatening situation, the Psychologist is obliged to take all necessary measures to provide assistance or refer the Client to the appropriate services.

4.5.10 Ethical use of new technologies. Psychologists must adhere to ethical standards when using digital technologies in therapy (telemedicine, online consultations), ensuring data confidentiality and an appropriate standard of therapy in a virtual environment.

4.6 Client's obligations and rights of the Psychologist.

4.6.1 The Client has certain responsibilities in the process of psychotherapy that contribute to effective cooperation with the Psychologist and a successful therapeutic process. These responsibilities may include:

4.6.1.1 Confidentiality. The Client must respect the confidentiality of the process by not disseminating information about other Clients if it becomes known during group sessions or other situations.

4.6.1.2 Active participation in therapy. The Client is obliged to take an active part in the therapeutic process, be open to working on their problems and honestly share their feelings and emotions with the Psychologist.

4.6.1.3 Adherence to the agreements on sessions. The Client must come to the sessions on time and notify about possible cancellation or postponement of the meeting in advance, but no later than 24 hours in advance.

4.6.1.4 Compliance with financial terms. The Client must comply with the agreed financial terms (payment for sessions on time), as this is part of the professional agreement with the Psychologist.

4.6.1.5 Compliance with the Psychologist's recommendations. If the Psychologist suggests certain tasks or exercises to be performed between sessions, the Client is obliged to try to complete them, as this is part of the therapeutic process.

4.6.1.6 Compliance with safety rules. The client is obliged to comply with the rules of behavior that ensure safety for himself/herself and others (for example, in the case of group therapy or family therapy).

4.6.1.7 Attentive attitude to one's health. The Client should be responsible for his/her health, including mental and physical health, and, if necessary, inform the Psychologist of any significant changes in his/her condition.

4.6.1.8 Respect for professional boundaries. The Client must respect the boundaries between professional and personal relationships with the Psychologist. Personal contacts outside of the therapy room, gifts, invitations to meetings may be unethical and harmful to therapy.

4.6.2 The psychologist may refuse to cooperate with the Client on the basis of ethical principles in the following cases:

4.6.2.1 Conflict of interest. If the Psychologist has personal or professional relationships with the Client that may affect the objectivity or independence of the therapeutic process.

4.6.2.2 Lack of competence. If the problem addressed by the Client is beyond the competence of the Psychologist, or he/she does not have sufficient experience to provide effective assistance.

4.6.2.3 Physical or psychological danger. If the Client behaves aggressively, threatens the safety of the Psychologist or other persons, the Psychologist has the right to terminate cooperation to protect his/her safety.

4.6.2.4 Ethical violations of the Client. If the Client demands actions that contradict ethical norms or the law, the Psychologist has the right to refuse to cooperate.

4.6.2.5 Lack of Client motivation. If the Client does not show interest in cooperation or regularly violates the agreements (skips sessions, does not follow recommendations), the Psychologist may terminate cooperation.

4.6.2.6 Change of working conditions. If the Psychologist believes that a change in the terms of cooperation (e.g., the duration or frequency of sessions) may worsen the outcome of therapy, he/she has the right to offer alternative options or terminate cooperation.

4.6.2.7 Inability to ensure confidentiality. If the Psychologist realizes that he/she cannot guarantee confidentiality due to certain circumstances, he/she has the right to refuse to work with the Client.

4.6.2.8 Transference or countertransference. If the Psychologist or the Client experience strong emotions towards each other that may interfere with the therapy process (e.g., falling in love), this may be grounds for termination of cooperation.

4.6.2.9 Violation of financial terms. If the Client does not fulfill financial obligations or regularly delays payment, the Psychologist has the right to refuse further cooperation.

4.6.2.10 Disagreement with the goals of therapy. If the Psychologist and the Client cannot agree on the purpose and methods of therapy, and this complicates effective cooperation.

4.6.2.11 Legal restrictions. If there are legal or regulatory reasons that prohibit the Psychologist from working with a particular Client (e.g., a legal conflict or court reporting obligations), the Psychologist has the right to refuse to cooperate.

4.6.2.12 Abuse of therapy. If the Client uses therapy to achieve unethical or illegal goals (for example, manipulating other people), the Psychologist may terminate cooperation.

4.6.2.13 The Client's inability to adhere to the therapeutic process. If the Psychologist sees that the Client is unable to participate effectively in the therapy process due to his/her condition (e.g., acute psychotic states, severe intoxication, drug or alcohol addiction).

4.6.2.14 Incorrect request from the Client. If the Client makes demands that do not correspond to the functions of the Psychologist (for example, legal or medical advice beyond the scope of the Psychologist's competence).

4.6.2.15 In any case, the refusal should be reasonable, ethical, polite and accompanied by an offer of alternative assistance, if possible.

5. GUIDELINES FOR USING THE SITE

5.1 The Site is an information and analytical platform created to facilitate the search for psychologists with the required specialization, qualifications and experience, in order to establish communication between the Client and the Psychologist, assisting Psychologists in providing their professional services, while Clients get access to convenient and confidential mental health consultations from these Psychologists.

To be clear, the Company does not provide any Therapy sessions, does not conduct Sessions, and is not responsible for them. The Company merely provides a digital platform that allows Clients and Psychologists to contact each other to book and conduct Sessions. The Platform for Psychologists is designed to receive orders for Sessions and manage their services on the Platform.

Psychologists are not employees of the Platform. The Platform does not enter into an employment relationship with any of the presented Psychologists.

5.2 To order a Session with a Psychologist, the Client shall contact the selected Psychologist directly by filling out the "Make an appointment with a psychologist" form on the Website.

5.3 Information about Psychologists on the Website is provided by the Website Administration based on the data received from Psychologists. The Website Administration shall verify the information provided to remove unreliable data and those that have been published without the consent of the Psychologists.

5.4 The Website Administration makes efforts to ensure the accuracy of the information published by Psychologists, but does not constantly update it. Clients must independently verify that the Psychologist has the necessary education, qualifications and certificates.

5.5 The rating of Psychologists on the Website is compiled in accordance with the criteria established by the Website Administration. The principles of rating formation may be partially or fully disclosed by the Website Administration at its discretion.

5.6 All exclusive rights to the Website and its content belong to the Website Administration.

5.7 The use of the Website content without the written permission of the Website Administration is prohibited.

5.8 The content of the Website is protected by copyright, trademark, other intellectual property laws and rules protecting against unfair competition.

5.9 The User has no right to demand changes in the services or content of the Website. The Website Administration is not responsible for the compliance of the Website with the commercial expectations of the Users, for the possibility of its adaptation to individual requirements, as well as for the absence of errors and defects in the software.

5.10 The use of the Website is at the user's risk. The Site Administration does not guarantee the continuous operation of the Site and is not responsible for any losses caused by the use of the Site, as well as for the risks associated with the incompatibility of the User's equipment.

5.11 The Administration strives to minimize problems in the operation of the Website, but does not ensure its continuous availability and is not obliged to inform about possible interruptions in operation.

5.12 The use of the program code of the Website and its content without the consent of the Website Administration is prohibited.

6. REGISTRATION AND ACCOUNT MANAGEMENT

6.1 To access the specialized functions of the Website and use its services, the User (after registration and verification - Psychologist) must create an account (Personal Account).

6.2 To log in to the Personal Account, the User shall use the e-mail address and password used during registration on the Website. The User shall be solely responsible for keeping the account information, including the password, confidential, as well as for all activities that take place under this account. The User may not disclose their password to third parties. If the password becomes available to a third party, the User is obliged to change it immediately.

6.3 In case of detection of unauthorized access to the account or other security problems, the User shall immediately notify the Website Administration thereof.

6.4 The User may face liability for damage caused to the Website or other Users as a result of the use of his/her account by third parties without permission.

7. CONFIDENTIALITY

7.1 The Website Administration may use cookies to improve the Website service, which are small files stored on the User's computer from the web server. They help to save the User's personal settings on the Website and collect anonymous information about their visits.

7.2. Detailed information on privacy issues is set out in the Website's Privacy Policy.

8. INTELLECTUAL PROPERTY RIGHTS TERMS AND CONDITIONS

8.1. By accepting these Terms, the User acknowledges and agrees that the services and content available through the Website are protected by copyright, patent, trademark or other rights under intellectual property law, except as specifically authorized by the Platform.

8.2. The User agrees not to modify, copy, sell, distribute or create derivative products based on the Platform and/or information from the Website, in whole or in part, except that the foregoing does not apply to the User's own published content that the User has legally uploaded to the Website.

8.3. In no event shall the Platform be liable for any information posted or transmitted by third parties, including Psychologists or Users, including, but not limited to, any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted on the Website. The User acknowledges that the Platform does not review the content, but the Platform and its authorized representatives have the right (but not the obligation) to refuse to post or destroy any content that may be posted through the Site at their discretion. Without limiting the foregoing provisions, the Platform and its authorized representatives shall have the right to remove any content that violates these Terms or for any other reason at the discretion of the Platform and its authorized representatives. The User agrees that he/she shall independently assess and bear all risks associated with the use of any content.

8.4. By accepting these Terms, the User is fully responsible for the content and other materials that the User posts on the Website. The User will not post any content if the User does not own all rights, including all copyrights thereto. By posting any information, any content published on the Site, the User grants and will grant the Platform the right to copy, display, transmit, distribute, store, modify and use it for an unlimited, irrevocable period of time.

8.5. The Platform may use the published content at its discretion for any purpose, including for promotion, advertising or marketing, in any form, using technologies now known or later developed.

8.6. The User acknowledges and agrees that the Platform may retain the content and may also disclose its content if required by law or disclosure is necessary to: a) comply with legal process under applicable law, or b) governmental requests; c) enforce these Terms of Use; d) respond to claims that any content violates the rights of third parties.

8.7. The Platform respects the intellectual property of others and expects Users to do the same. If you believe that your work has been copied in violation of copyright or that your intellectual property rights have been violated, you may notify the Website Administration by sending an e-mail to the following address: office@terappio.com.

9. ELECTRONIC INTERACTION

9.1 The Administration provides Psychologists with the opportunity to use the Personal Account for electronic interaction through the Website, which becomes available after registration.

9.2 The interaction between the User and the Website Administration shall be carried out by means of e-mail correspondence.

10. RESPONSIBILITY

10.1. By using the Platform, each User understands and agrees that all advice, information, methods of practice, sessions, products, specialists, consultants, tests, opinions or other information or services in writing or provided by Psychologists in any form, are neither employees, employees of the Company and/or controlled by the Platform. Each User understands and agrees that the Platform cannot predict or evaluate the competence of any Psychologist presented on the website and its compliance with the User's needs.

10.2. The Platform shall not be liable for canceled consultations (Sessions) or any unfulfilled agreements between Clients and Psychologists or any injuries resulting therefrom, or damage resulting from the use of the Platform in general.

10.3. Users are advised to conduct their own research to select a Psychologist.

10.4. Users who interact with Psychologists through the Website acknowledge that such relationship is solely with the specialists with whom they interact, and in no way with the Platform and/or the Company.

10.5. Psychologists hereby acknowledge that they are solely responsible for any advice, information, methods, links to other specialists, consultants, procedures, tests, opinions or any other information or services provided in any form to any User of the Platform.

10.6 The User assumes full responsibility for any losses caused by intentional or negligent actions that lead to a violation of the terms of this Agreement, or due to illegal access to the personal information of other Users. Compensation for such losses is not provided by the Website Administration.

10.7 The Website Administration is not responsible for:

10.7.1 Delays or failures occurring for reasons beyond its control, including force majeure, as well as malfunctions of telecommunication, computer, electrical and other related systems.

10.7.2 Actions and omissions of financial institutions and money transfer systems, as well as any delays arising from their operation.

10.7.3 The Website Administration shall not be liable for the lack of access to the Website if the User does not have the necessary equipment or technical means for its use, and shall not be obliged to provide the User with such means.

10.7.4 The Website Administration is not responsible for the quality of services provided by Psychologists, regardless of whether the profiles of these specialists are available on the Website.

10.8. Notwithstanding any damages that the Client may incur, the total liability of the Company and any of its suppliers under any provision of these Terms and the Client's exclusive remedy for all of the foregoing shall be limited to the amount that the Psychologist has actually paid through the Website for the provision of services to such particular Client attracted through the Website, in the manner and to the extent specified in clause 3.4 of these Terms.

10.9. The Company shall not be liable for any damage caused to Clients by Psychologists and/or vice versa. The Psychologist is obliged to provide appropriate education, training, experience, license or certification in his/her field of activity, if such accreditation is required for the provision of the Service in accordance with the applicable law for the Psychologist.

11. VIOLATION OF THE TERMS OF THE AGREEMENT

11.1 The Website Administration has the right to disclose the User's personal data if necessary to conduct investigations or respond to complaints regarding the misuse of the Website, as well as to identify the person who violates the rights of the Website Administration or other Users.

11.2 The Website Administration reserves the right to disclose information about the User to the extent necessary to comply with the law, enforce court decisions or enforce the terms of this Agreement.

11.3 Information about the User may be disclosed to the bodies authorized by law on the grounds and in the manner prescribed by law.

11.4 In case of violation of the terms of the Agreement by the User, the Website Administration has the right to restrict his/her access to the Website without prior notice, due to the termination of the Website operation or technical problems.

11.5 The Administration shall not be responsible for termination of the User's access to the Website if it is the result of violation of the terms of this Agreement.

12. DISPUTE RESOLUTION

12.1 Before going to court to resolve the dispute, the parties undertake to try to resolve it by submitting a written claim for voluntary settlement.

12.2 The party receiving the claim shall, within thirty days from the date of receipt, notify the other party of the results of the claim consideration.

12.3 If the parties cannot resolve the dispute through negotiations, they may apply to the court in accordance with the current legislation of the Republic of Estonia to protect their rights. The law governing these Terms is the law of the Republic of Estonia.

13. OTHER TERMS AND CONDITIONS

13.1 If any provision of the Terms is held to be unenforceable or invalid in whole or in part for any reason, such provision shall be limited or eliminated to the minimum necessary to ensure that the Terms remain in full force and effect. The Parties shall use their best efforts to replace such unenforceable or invalid provision with a new valid and enforceable provision.

13.2 A printed version of this Agreement and any notice in electronic form shall be admissible in court or administratively based on or in connection with this Agreement to the same extent and under the same conditions as other business documents and records originally created and maintained in printed form.

13.3. The section headings of these Terms of Use are for convenience only and have no legal or contractual effect. Notification to you may be made by e-mail or regular mail. The Site Administration may also provide you with notifications of changes to these Terms of Use or other issues by displaying notifications or links to notifications on the Site.

13.4. By registering on the Website and/or sending an application for an appointment with a Psychologist, each User agrees to use his/her e-mail address to receive notifications necessary for the functioning of the Platform. This includes, but is not limited to, confirmation of registration, reminders of sessions, notifications of their appointment, cancellation or change, as well as information about payment and its status, complaints, etc. Such notifications are an integral part of the Website's operation and cannot be disabled.

In addition, with the separate consent of the User, the Platform may send informational and marketing newsletters, including news about functional updates, special offers, promotions and useful materials. In case of unwillingness to receive such additional messages, the User may refuse them at any time by contacting the Website Administration at office@terappio.com.

13.5 We do our best to ensure the protection of Users, but we cannot provide guarantees regarding the constant technical serviceability of the third-party services used by us.
